Tark & Co partner Hannes Vallikivi participated in the Annual Conference of the International Bar Association (IBA), Singapore on October 14-19. Mr. Vallikivi was one of the speakers in the “Legal opinion practice” workshop, organised by the Banking Law Committee.

Description

Over the past 30 years, the giving and receiving of third party legal opinions has developed into a specialised area of practice. That practice is largely governed by customary law. This session focused on practical aspects of drafting opinions as well as on exploring the practices of firms, their policies and procedures for giving and receiving opinions.

Panellists discussed whether legal issues could be resolved by factual inquiries, to what extent third party recipients and their successors or assignees might rely on opinions, the dos and don'ts of incorporation by reference including the request of recipients to issue bring-down letters, all with a view that opinions should provide assurance rather than insurance.

 This year the Conference was the biggest ever with over 4000 participants from more than 120 nations attending. The next conference will be held in Buenos Aires in October 2008.
